Terms Of Service
By ordering a commission from me, user anubisemporium ("the Artist"), you ("the Client", "(s)he/ they") affirm to have read and agree to be legally bound by the following Terms of Service listed below. Failure to abide by the Terms of Service may result in a rejected/ cancelled commission with or without a refund, and/ or a blacklist/ public service announcement. Please note that these Terms of Service may be subject to change without prior notice.These Terms of Service are in effect as of JUNE 5, 2025.Note: Items with the symbol ($) Will have some sort of price to manage/add/remove. Be mindful of this.
Limits
Section 1.1 - Will Draw
The Artist is willing to draw any of the following:- Humanoids- Anthros- Ferals- Original Characters and/ or Fan Characters- Sonas- Large groups $- Detailed Backgrounds $- Fanart- Mechas/Mechanical Parts $- Objects/Food/Items/Weapons- Light Gore (Ex. Excessive blood, detached limbs, etc.)- Implied Sexual Content and NSFW $- Any couple type of any sexuality. This includes but is not limited to:
----- Canon x Canon
----- Canon x OC
----- OC x OC
Section 1.2 - Will Not Draw
The Artist will not draw any of the following:- Realistic Animals (My style is nowhere close to being realistic!)- Heavy gore
(Ex. Detailed internal body parts)- Realism- Anything attacking a group of any sort.- Sexualized underage characters (in actual age and appearance)- Pedophilic relations- Incestuous relations- Certain kinks/ fetishes (ex. watersports, DDLG, fat fetish, etc...); the Client is asked to confirm with the Artist beforehand if a certain kink/ fetish is acceptable.
Section 1.3 - Ask To Draw
The Artist might draw any of the following based on your request:- Real Life People- Live2D $- Horror / Heavy Gore $- Candy Gore- Mood Board Inspired $- Description Only $
General
Section 2.1 - Rights & Requests
- The Artist has a right to refuse the commission for whatever reason, with or without explanation. This can apply due to not being able to complete the commission, it is outside of my abilities, or even feeling uncomfortable while making it.- The Artist has a right to cancel the commission for whatever reason, with or without explanation. This can apply due to not being able to complete the commission, it is outside of my abilities, or even feeling uncomfortable while making it. (Please see Section 6 - Refunds for more information on cancellations.)- The Client has a right to cancel the commission for whatever reason, with or without explanation. (Please see Section 6 - Refunds for more information on cancellations.)- The Artist has a right to upload the commission on any/ all social media (Tumblr, Twitter, DeviantArt, Toyhou.se, Instagram, etc.) unless specified by the Client beforehand to keep the commission private.- Payment is to be made after the Client has approved the sketch.
----- The sketch will be resized and watermarked.
----- The commission will be on an "on hold" status until payment has been received.- The Artist will not work with deadlines or rush orders.- The Artist does not work on a "first come first serve" basis. Smaller commissions/ commissions that do not take much time may be worked on in between larger commissions/ commissions requiring more time.- NSFW commissions may only be ordered by a Client 18 years of age or older.
----- If the Artist has any reason to suspect the Client is underage while asking for an NSFW commission, the commission will be automatically rejected/ cancelled, in addition to a public service announcement being made.
----- If Client is also trying to provide an NSFW commission to a minor or suspected of such, local authorities will be contacted and an FBI report will be made.- Please write in a nice and clear manner as though communication is key. I will be communicating with you throughout the process.
Image Rights
Section 3.1 - Artist Rights
- The Artist does not claim ownership to any of the characters/ subjects portrayed in the commission. Characters belong to their respective creator(s).- All of my works are for personal use only. Do not claim the art as your own, use it in any commercial ways, or sell the artwork without my permission.- As the artist, I hold every right to the produced drawing, not the commissioner. Therefore I'm allowed to use the copyrighted artwork to do the following:
----- Promote myself within any place or site
----- Display it anywhere to my liking
----- Post it wherever I want.
Section 3.2 - Commissioner Rights
- The Client may make minor edits to the completed commission (ex. Cropping, Adding text/ borders, Changing Brightness/ Contrast/ Hue/ Saturation...).- The Client may not claim the commission as his/ her/ their own work, whether (s)he/ they did or did not make any edits to the commission.- The Commissioner however may do the following:
----- May use the copyrighted artwork for personal use only unless agreed otherwise
----- Print the art for personal use
----- Claim the right of their character(s) but not the drawing itself.
----- Use the art to promote themselves with proper credit given to the artist.
Section 3.4 - Payment & Punishment For Rights
- Breaking these terms will result in an instant violation of copyright law and your artwork will be retracted from you. Any form of attempting to use the artwork after being warned of such activity will result in legal activity.- However, If you do wish to use my artwork for sales, that will be a MINIMUM one-time fee. The price will vary based on time taken and/or production expectation.- Know that you must still credit me as the artist somewhere on the website, application, and/or any place where credit can be due.
Delivery & Turnaround
Section 4.1 - Delivery
- All commissions will be done digitally.
----- There will be no hard copies.
----- The Client is paying for a service/ digital good and will not require any shipping of any kind.-All commissions will be done in a personalized style or as sampled in the style ordered.
Section 4.1 - Turnaround
- Commissions take time and I have several things to do outside of drawing; your commission may take up from 2 days to 1 month due to the following: health, school, family, other daily needs, and/or complexity of the commission.
----- You will be notified of any delays per the chance they do occur.
----- Unless specified not to upload the commission to the public, all commissions will be posted on the Artist's social media, resized and watermarked.- Commissions will be posted on the Artist's social media after the Client has received and approved the original and unmarked commission file.- The Client may choose to remain anonymous when the Artist publicly uploads the commission.
Payment
Section 5.1 - Payment Time & Type
- Payment is to be made after the Client has approved the sketch. The Client is not to send payment upfront.- Payment is to be made via online apps, absolutely no checks or cash will be taken.
----- All payment is to be done in USD (United States Dollars).
----- Payment is be done using invoices or I sent a link to the Client.
----- The Artist will supply the email/link/username associated with the account to continue payment.
----- I can take Stripe, PayPal, Venmo, CashApp, and Zelle for USD. These will automatically transfer to my monetary unit from yours if you are not using USD.
----- Please be sure to check any fees, I am not responsible for any fees through these services.
----- The commissioner will pay the full price after the sketching phase. Any added fees will be added before sending the final product without a watermark. This cannot be refunded unless Section 6 activates.- The commissioner will receive several sketches and statuses of the artwork.
----- Any adjustments must be made within the sketch stage.
----- You will be notified of your final decision; however, changing the colors AFTER the flat color stage will result in a fee.- The rest of the payment will be requested based on the calculation in section 5.2. This is how I should be paid based on minimum wage and other complications.
Section 5.2 - Price Formula
Final Price = Base Price + Added Prices + Extra Fees - Any Discounts
- The base price is the price paid before the commission is begun, this happens after the sketching stage with confirmation from the commissioner.
----- "Added Prices" mean for an additional price. Simply meaning an added price for complex backgrounds, designs, ect.
----- "Extra Fees" include any alterations after the flat-color stage as mentioned above. These add up with each alteration if it is not minor.
----- Discounts occur when I have a sale of some sort. These are normally a set price like $10 for example. You will be notified of any discount at the time of sale.
----- Any extra payment that occurs during the process for added fees must be paid before the final product is sent.-Failure to pay will result in your commission being on hold or canceled with no refund.- Payment must be sent within 72 hours after confirmation.- Failing to pay or communicate with me regarding payment will result in a blacklist and all servers and communities that I am in will be notified of your failures.
Refunds
Section 6.1 - Client Cancel
- If the Client cancels his/ her/ their commission for whatever reason, the Client will receive a partial refund, depending on how much of the commission has been finished:
----- 80% in the sketch stage.
----- 60% in the line art stage.
----- 40% In the coloring stage.
----- 0% When fully completed/rendered.- The Client will not receive any files of the commission.
Section 6.2 - Artist Cancel
- If the Artist cancels the commission for whatever reason, the Client will receive a full refund.
----- Refunds will be given within 72 hours after correspondence.- Please follow the TOS and avoid any negative behavior that can make me decline your commission. These include but are not limited to:
----- Harassment
----- Constant nagging of time taken
----- Known of Scamming
----- Denial of paying the amount requested.
Section 6.3 - Unsatisfied Client
- The Client will not be refunded if (s)he/ they are unsatisfied with the commission.- If the Client is unsatisfied with the commission, the Artist is willing to discuss and make minor edits.
----- Client will be not charged after smaller changes. Only large ones.
----- Any desired major revisions (ex. reposing, color scheme change, etc.) will be charged and added to the total.- The only major revisions permitted are details that the Artist may have missed and was specified by the Client in the order form/ correspondence while the commission was still in the sketching/ lineart stage (ex. missing tattoo that's essential to the character's design). This is my fault and you will not be charged.

Section 7.3 - Steps
- After contacting me, You will receive a confirmation message from me. After that, we will continue to discuss everything that you would like the commission to be.
----- Once approved I will begin the sketch.
----- Once you confirm the sketch, you will pay the price discussed from there.- The commission will be worked on and you can ask for updates and images as you please. Everything will be watermarked.- Once the piece is done, if there was any extra fees added during the process, it is mandatory that those are paid before I send you the non-watermarked file.
